Amendment VI to the US Constitution: “In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.” https://www.law.cornell.edu/constitution/sixth_amendment

Even a short delay, with the defendant out on bail, can cause irreparable harm to the innocent. For instance, if the defendant is seeking employment or applying to a university. Being held indefinitely, while awaiting trial, is even more damaging.

In Sabatini’s historical novel about the English Monmouth Rebellion in the 1600s, the accused were kept for two months in pre-trial detention: “I am guilty of nothing to justify any of those words I have heard used to describe me, unless it be of a want of patience at having been closely confined for two months and longer in a foetid gaol with great peril to my health and even life…” (Peter Blood) Many of those who protested on January 6, 2021 have been kept far longer. In the DCFox5 interview, Matt Braynard reveals the real reason for the rallies, which is to bring attention to those held in lengthy pre-trial detention. The first rule of protest was always to invite the media, though these days you can be your own media.

That, my dear readers, is the general purpose of protest – to educate people.

There are other ways that you can raise the profile of the J6 detainees, such as speaking with family and friends; calling elected officials, donating, etc. All protest is risky these days. Some think these protests are a bad idea. Only you can decide if this is the way that you wish to support the J6 detainees. That being said, if people don’t exercise their rights, then they can lose them. The safest protest is a small one where you know everyone present, as well as local laws and follow them. However, there are no guarantees.

While Matt Braynard has stated, in the recent DC Fox5 interview, that this protest isn’t for the violent offenders, those accused of violence should have the right to a prompt and fair trial, and access to a lawyer, as well. Those who were not accused of violence against human beings should have been given a fine. But, even those accused of true violence should not be in pre-trial detention for 9 months. This is in violation of the 6th Amendment and Americans are supposed to have the presumption of innocence.
