The goal and rationale of this proposed rule are highly commendable, but are completely eviscerated by provision for ACLs based on proof that the operator has made “reasonable” efforts to restore the aquifer. As currently written, the proposed rule gives very little hope that any aquifer subjected to ISR will be restored to baseline conditions.” Harrison Karr, Navajo Nation, Department of Justice (DOJ) [ACL, Alternate Concentration Limits, are exemptions; ISR is better known as ISL (In Situ Leach)]

Note that the 30 year monitoring period is not 30 years but 3 years. Additionally, besides granting ACL exemptions, the EPA has failed to lay out a clear, methodologically and statistically sound policy for assessing water baseline.

Uranium, as a heavy metal, damages the kidneys. It is also believed to cause diabetes.

CBR is Cameco’s ISL Uranium mine. Pine Ridge is a Lakota Sioux Indian Reservation: “It is believed there is a relationship between the ninety-eight (98) closed wells on the Western side of Pine Ridge Indian Reservation and certain incidences of cancer, kidney disease, birth defects, miscarriages and infant brain seizures on the Reservation which is downwind and downstream of CBR’s existing ISL mining operation. Under the doctrine of Res Ipsa Loquitor, the burden of proof shifts to CBR to show that its operations have no causal connection to the contamination of the Pine Ridge water wells or the diseases of the people who drank and bathed in that water.http://pbadupws.nrc.gov/docs/ML0733/ML073370202.pdf

What kind of government-people takes another people’s land only to destroy it? Even crazier, the US government has taken American Indian land simply to hand it over to foreign mining interests such as Canada’s Cameco uranium and Russian State owned Uranium One. All that the American Indians ask is a respect for clean water, air and land, and more rarely to protect sacred sites. That’s not much and it’s a win, win for all Americans.
