Cameco Crow Butte ISL Nebraska
Cameco Crow Butte ISL Uranium Mine in Nebraska aka CBR

It is believed there is a relationship between the ninety-eight (98) closed wells on the Western side of Pine Ridge Indian Reservation and certain incidences of cancer, kidney disease, birth defects, miscarriages and infant brain seizures on the Reservation which is downwind and downstream of CBR’s existing ISL mining operation. Under the doctrine of Res Ipsa Loquitor, the burden of proof shifts to CBR to show that its operations have no causal connection to the contamination of the Pine Ridge water wells or the diseases of the people who drank and bathed in that water.” ML073370202 http://pbadupws.nrc.gov/docs/ML0733/ML073370202.pdf [Note that of four water samples tested in 2009, two in Crawford, Nebraska and two at the Pine Ridge Indian Reservation, there were illegal amounts of radioactive alpha emitters and arsenic.(1)]

The following, dated May 12, 2015, was submitted to the US EPA as part of an ISL uranium mining water restoration comment. Our ability to read this, and the above document is why the whole idea of comment and public record is so important. It is signed by the Attorney for the West Nebraska Resources Council(WNRC).

The original submission is 57 pages long. Unfortunately, they, along with others, appear to have been lulled into complacency over the new EPA proposed rules, which fail to lay out a clear and statistically valid methodology for assessing water baseline. A clear methodology would also save the taxpayer court costs. Vagueness keeps lawyers in business. Additionally, the EPA proposal makes clear that their hands are tied regarding exemptions handed out by the NRC. Info on the 1989 FBI-EPA Raid at Rocky Flats at bottom of this post

The US NRC and US EPA are both entities, which endanger public safety. There is more hope for the FBI helping

The FBI and the US EPA are probably mixed bags with good and bad people. However, at this point there is more hope that the FBI would do something good. We place it at 50/50. Even so, they have been spying on environmentalists. (2)

While the vast majority of US NRC workers are apparently against public safety, the US EPA isn’t doing much better, if at all. Below are but two examples of the problem. The US NRC must be shut down. The US EPA needs a serious house-cleaning and may need shutting down. We recommend that all NRC workers and offending EPA workers be sent to clean-up nuclear sites around America and even Fukushima, as just punishment for their crimes of omission and commission. US EPA “expert” Michael Boyd has inverted the radiation safety standard such that more radiation is better for you. As such, he is an immediate risk to the safety of nuclear workers, as well as a long-term risk to everyone else. It doesn’t matter if this is by design or due to an easy and simple error. There is no room for error with radiation.

For Michael Boyd see: https://miningawareness.wordpress.com/2014/07/31/nuclear-effective-dose-radiation-icrp-vs-us-epa/

Besides dangerously playing with safety and stats for reactor pressure vessels, baseline water standards, and more, the NRC has left a dangerous typo on their web site. They read this post in October, according to our records, and still have not corrected it: https://miningawareness.wordpress.com/2014/09/04/the-dangerous-us-nrc-typo-making-low-level-radioactive-waste-more-radioactive-than-allowed-at-wipp/

FBI Spying on Environmentalists

Although it was supposedly done without official permission, it was still done. http://www.commondreams.org/news/2015/05/12/fbi-spied-beyond-its-authority-keystone-xl-opponents More at note 3.

DRINKING WATER TESTS CONDUCTED ON THE PINE RIDGE RESERVATION IN 2008 AND 2009 Water samples were taken from 10 homes on the Pine Ridge in various communities. In 6 out of the 10 homes tested, the results showed MCL’s (Maximum Contaminant Level) for gross alpha emitters (radionuclides) that exceeded legal limits. When drinking water test results reveal contaminants higher than the MCL, that drinking water is considered by the EPA to be unfit for human consumption. Two test results showed illegal MCL for arsenic. “The reason why I started the water tests on Pine Ridge was a health concern. I know about the huge health problems and did a lot of research of these extreme rates of cancer, diabetes, and kidney failure. Contaminated drinking water is a big threat to little children, that is why in Germany the MCL for uranium is different for adults (15pC/L) than children (02pC/L). Six of our 10 samples are definitely a health risk for alpha emitters. The water result from one home for gross alpha was 42pC/L. That is much too high for drinking water.” Homes included in the test sampling were in the locations of Porcupine, Manderson, Potato Creek, and Sharps Corner. Water sources included the Rural Water Pipeline and wells into the Arikaree Aquifer.

WATER SAMPLES TESTED IN 2009 Four homes participated in the water testing done in early 2009. Two of these homes were on the Pine Ridge, and two were in Crawford, Nebraska. The test results for all four homes showed illegal MCL’s for alpha emitters, uranium, uranium activity and arsenic. The drinking water from four additional homes were tested in the fall of 2008, with the test results returning in early 2009. Two of the four homes test results came back with illegal MCL’s for radionucleides. More testing needs to be done. In all three rounds of this independent water sampling, although some of the test results showed clean drinking water, illegal MCL’s for contaminants were found. The laboratory utilized in the testing was the same lab used by the Cameco uranium mine and the Oglala Sioux Tribe Rural Water Program as tests can be done only by lab’s certified to test radioactive substance such as uranium. The tribal members on Pine Ridge and the citizens of Crawford have all been made aware of the test results and want to participate in further testing. It costs about $1600 to complete four tests in the required time period to be acceptable under standards established by the EPA. The drinking water tested on Pine Ridge comes from the Arikaree Aquifer and the White River Alluvium. The testing was conducted by Aligning for Responsible Mining (ARM).

ARSENIC THE UNITED STATES EPA OFFICE OF DRINKING WATER HAS SET A MAXIMUM CONTAMINANT LEVEL (MCL) FOR ARSENIC IN DRINKING WATER OF 10 PPB. THE WORLD HEALTH ORGANIZATION RECOMMENDS A PROVISIONAL DRINKING WATER GUIDELINE OF 10 PPB. A RECENT ARSENIC REPORT OF THE INDIAN HEALTH SERVICE STATES THERE ARE MORE THAN 120 WELLS ON PINE RIDGE WITH MCL’S OF ARSENIC HIGHER THAN THAT ALLOWED BY LAW, MOST OF THE HOMES NOW RECEIVE RURAL WATER PIPELINE WATER OR THE RESIDENTS HAVE MOVED AWAY OR DIED. THE INDIAN HEALTH SERVICE PROVIDED FILTERS FOR THE HOMES STILL OCCUPIED.http://www.mining-law-reform.info/lakotasurvival.pdf

Regarding the Rocky Flats FBI Raid and Case
Colorado Federal District Court Report of the Federal District Special Grand Jury 89-2 January 24, 1992http://www.constitution.org/jury/gj/rocky_flats/rocky-flats-grand-jury-report.htm

MARCH 23, 2004
Book Discussion on The Ambushed Grand Jury: Govenment Nuclear Crimes
A panel discussed the book The Ambushed Grand Jury: How the Justice Department Covered Up Government Nuclear Crime; And How We Caught Them Red Handed, published by Apex Press. From 1952 to 1989, the Department of Energy’s Rocky Flats Plant, located just outside Denver, Colorado, manufactured plutonium triggers for nuclear warheads. In 1989, the FBI raided the plant to investigate charges that plant managers were violating federal environmental and safety laws. A grand jury later recommended that managers from DOE and Rockwell International be indicted, but the U.S. attorney handling the case, Mike Norton, instead struck a deal with Rockwell. As part of the deal, members of the grand jury were ordered not to discuss their investigation and their grand jury report was kept secret. During this panel discussion, Wes McKinley, the grand jury foreman, his attorney and co-author, Caron Balkany, and former plant employee, Jacque Brever, talked about the case and argued that the U.S. government is guilty of covering up serious crimes…
